Terms of Use

These Terms of Use ("Terms") were last updated on February 28, 2021.

The purpose of Sammal Human Tech is to offer services and products for more empowered individual wellbeing. We need rules to keep our services safe for you, us, and our community. These Terms apply to all your activity on the Sammal Human Tech website, Sammal Human Tech events, Sammal Human Tech sessions, products delivered through our platforms and other related services (“Services”).

By registering for our coaching, workshops or events, and by ordering any products through our platforms, you accept the terms of this Agreement and agree to abide by them. In addition, when using these Services, you must comply with any other guidelines or rules applicable to such Services. Any participation in this Service constitutes acceptance of this agreement.

It is important to understand that we focus on people who are able to take full responsibility for themselves. Even if the activities we offer apply techniques developed in the field of humanistic psychology and psychotherapy, our goal is not to provide therapy per se: our coaching and Services are aimed at personal empowerment and spiritual growth.

The processes of coaching, workshops and products we offer can be uncomfortable, contradictory, painful, and can trigger all kinds of emotions. The techniques used are part of a number of different spiritual practices that can be experienced to have profound healing effects, but should in no way be expected to be therapeutic. All participants are invited to participate in these activities of their own free will and choice and at their own risk. Participants are invited to take responsibility for their own boundaries and constraints and to take responsibility for the adequacy of their resources.

The Services we offer require fundamental mental and emotional stability, and the services we offer are not suitable if you suffer from serious mental disorders or illnesses that have not been previously treated in professional therapy settings. We also ask you to take responsibility for your own physical health and well-being.

Therefore, we recommend medical assistance or psychological / psychiatric treatment for those who may have medical or psychological issues or for those on medication that may prevent and / or interfere with the activities provided in the Services.

We at Sammal Human Tech do not claim to be perfect, fully developed, enlightened or complete role models. We are not doctors or psychotherapists either. We provide these tools and practices in good faith, without any intent to harm. We are here to facilitate and support your conscious growth process, yet understand that growth is your responsibility and your cause.

Payments, credits and refunds

Pricing

We regularly run offers and promotions for our courses, and certain courses are only available at a discounted price for a certain period of time. The price applicable to the course for you is the price you confirm for payment for the course at checkout. The price offered for a particular course may also differ between existing and new users, as some of our offers are only available to new users.

Payments

You agree to pay for the Services you have purchased, and authorize us to charge your debit or credit card or use other payment methods (such as SEPA, direct debit or mobile payment) for these payments. Sammal Human Tech works with third-party payment processing partners to provide you with the best payment methods and to keep your payment information secure. By making a purchase, you agree not to use an incorrect or unauthorized method of payment. If your payment method fails and you still get access to the Service you have enrolled in, you agree to pay us the corresponding fees within fourteen (14) days of receiving notice from us. We reserve the right to deny access to any course for which we have not received adequate payments. In addition, after 2 payment orders, we transfer our receivables to the collection agency for collection.

Refunds and rebates

If the course you purchased is not what you expected, you can request that Sammal Human Tech refund / rebate your payment (“money back guarantee”). A request for a refund / rebate must be made within 14 days of the end of the use of Service. The money back guarantee is only valid if you have actively participated in the Service. We reserve the right to process refund requests and reject a request if the terms of the money back guarantee are not met. If the terms of the money back guarantee are met, we will refund the course fee, less a 5% transaction fee. Alternatively, we may offer a rebate on the account you use in our service. We reserve the right to use a refund or refund at our discretion, depending on our payment processing partners or the platform from which you purchased the course. You will not be refunded or rebated if you request it after the 14 day warranty period.

Use of Sammal Human Tech Services at your own risk

Sammal Human Tech allows conscious creators to create and share content, methods, courses and technologies on themes of rising awareness. By using the Services, you may be exposed to content that you may find offensive, obscene or vague. Sammal Human Tech has no responsibility to keep such content from you and we have no responsibility to access or register the material sharing in any way, to the extent permitted by applicable law. This also applies to all contennt related to health and well-being, physical, mental or energetic training. As a participant, it is your responsibility to identify the risks and hazards of the heavy nature of these types of services, and by enrolling in such services, you choose to take these risks voluntarily, including the risks of illness, injury, or death. You take full responsibility for the choices you make before, during and after enrolling in the service. In case of doubt, we recommend that you discuss your involvement with your doctor and any other caregivers. None of the services we offer or provide will replace visiting a doctor or other caregiver such as a psychologist / psychotherapist under any circumstances.

Moreover, by enrolling into our services, you agree to respect the IP rights of the originators of the content of the service. By applying any and all of the techniques and technologies attained through our services, you take full responsibility for the outcomes of such activities - towards yourself and anyone with whom you utilize these tecniques and technologies. For the individuals who are interested in sharing any and all of our services, we invite you to contact us in becoming one of our Ambassadors. Other issues

Binding agreement

You agree that by registering, accessing or using the Services, you agree to enter into a legally binding agreement with Sammal Human Tech. If you do not agree to these terms, do not register or otherwise use our services.

If you are a Guide who accepts these terms and use our Service on behalf of a company, organization or other legal entity, you represent and warrant that you are authorized to do so.

Any version of these terms in a language other than Finnish is provided for clarity and convenience. You understand and agree that the Finnish version will prevail in the event of any conflict.

These terms (including all agreements and practices relating to these terms) constitute the entire agreement between you and us.

If any part of these terms is found to be invalid or unenforceable under the applicable law, the enforceable provision in question shall be deemed to replace the existing provision in the manner best suited to the purpose of the original provision, the remaining terms remaining in force.

Even if we delay the exercise of our rights or do not exercise our rights in any particular case, it does not mean that we waive our rights under these terms. So we can decide to implement them in the future. If we choose to waive our rights in a particular case, it does not mean that we waive our rights in general or in the future.

Limitation of Liability

There are risks associated with using our services (for example, if you enroll in a health and wellness course such as yoga and injure yourself). You fully accept these risks and agree that you will not be entitled to claim damages even if you suffer loss or damage from the use of our operating system or Services. In legal language, to the fullest extent permitted by law, we (and our affiliates, suppliers, partners and agents) shall not be liable for any indirect, incidental or consequential damages (including loss of data, income, profits or business opportunities, personal injury or death), whether by contract , warranty, damage, product liability or otherwise, and even if we have already been notified of the possibility of damages in advance. Under no circumstances will our liability (and the liability of each of our group companies, suppliers, partners and agents) to you or third parties exceed the amount you have paid us during the twelve (12) months prior to the event giving rise to your claim.

Compensation

If you behave in a manner that causes us legal difficulties, we may seek legal redress against you. You agree to indemnify and to respond to third party claims, losses, damages, or expenses resulting from (a) you sent or shared with that content, (b) the use of services, (c) your violation of these terms, or (d) infringement of third party rights. Your indemnification obligation will survive the expiration of these terms and conditions and your use of the Services.

Applicable law and jurisdiction

Finnish law applies to these terms. If, in the application of this Agreement, a dispute arises as to the correct content of the Agreement or as to what is correct and reasonable in any respect, the Agreement shall be reached primarily through negotiations between the Parties. If no agreement is reached in the negotiations, the matter will be resolved in the Helsinki District Court.

Legal action and notifications

Neither party may bring any action arising out of or in connection with the Agreement, in whatever form, more than one (1) year after the cause of action arose.

Terms update

We may update these terms from time to time to clarify our policies or to reflect new or different policies (such as when we add new features). Sammal Human Tech reserves the right, in its sole discretion, to change and / or make changes to these Terms at any time. If we make significant changes, we will notify you in a visible manner, such as by an email notification sent to the email address specified in your account, or by sending the notification through our Services. Amendments shall enter into force on the date of their publication, unless otherwise stated.

Continued use of our services after the changes take effect means that you accept the changes. The revised, published terms replace all previous terms.
